Relationship Between International Law and Domestic Law: A Critical Analysis of the Spanish Legal System in the Light of the Monist Theory

Resumen: Monist theories share the central idea that international law and domestic law form a common body of law. A proper analysis of the forms of integration of international law into domestic law must start from the differences between the sources of international law. The aim of this paper is a critical analysis of the relationship between international law (both conventional and customary) and the Spanish domestic law in the light of the monist theory. The international dimension of the Autonomous Communities will also be considered in this paper.
